Waste Clearance Lambeth Standard Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Lambeth provides waste collection, rubbish removal, and related services to domestic and commercial customers within our service area. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, business, or organisation requesting or receiving the services.

Company means Waste Clearance Lambeth, the service provider.

Services means all waste clearance, collection, loading, removal, transportation, and disposal activities carried out by the Company.

Waste means any household, commercial, or other non-hazardous materials collected by the Company under these Terms and Conditions.

Agreement means the contract between the Customer and the Company, consisting of these Terms and Conditions together with any written quotation or booking confirmation.

2. Scope of Services

The Company provides waste collection and clearance services including, but not limited to, removal of general household waste, bulky items, garden waste, light construction waste, and commercial rubbish within our operational service area.

The exact scope of Services for each job, including the type and estimated volume of waste, collection location, access arrangements, and any special requirements, will be confirmed at the time of booking or in a subsequent written confirmation or quotation from the Company.

The Company reserves the right to refuse to collect any items that, in its reasonable opinion, pose a health and safety risk, are hazardous or prohibited waste, or are otherwise unsuitable for collection or disposal through our standard processes.

3. Booking Process

Bookings may be made by telephone, email, online form, or any other method offered by the Company from time to time. The Customer must provide accurate and complete information when requesting a booking, including the property address, access details, approximate volume or description of waste, and any relevant time constraints.

Any quotation provided based on the Customer’s description of the waste and circumstances is an estimate only and is subject to confirmation by the Company’s operatives upon arrival. If, on arrival, the waste volume, type, or access conditions materially differ from the description provided at booking, the Company may revise the quotation. The Customer will be informed of any change in price before work continues.

A booking is deemed accepted, and an Agreement formed, when the Company issues a booking confirmation or when the Customer accepts a quotation provided on site and the Company commences work. The Company may, at its discretion, require a deposit or pre-authorisation to secure the booking.

4. Access And Customer Obligations

The Customer must ensure safe, reasonable, and lawful access to the collection point at the agreed date and time. This includes providing any necessary entry codes, permissions, parking arrangements, and ensuring that the area is free from unnecessary obstructions.

The Customer is responsible for obtaining any permits, consents, or approvals required for the Company’s vehicle to park or load, such as parking suspensions or access permissions. Where the Company assists with such arrangements, this does not transfer ultimate responsibility from the Customer.

If the Company’s operatives cannot access the waste due to locked gates, blocked access, restricted parking, or other reasons outside the Company’s control, the Company may charge a call-out or waiting fee and may treat the visit as a failed collection.

5. Waste Types And Regulations

The Company will only collect and transport waste that is permitted under applicable UK waste and environmental regulations. The Customer must not present for collection any hazardous, clinical, chemical, or otherwise controlled waste, including but not limited to asbestos, clinical sharps, liquid chemicals, solvents, oils, gas bottles, paint tins containing liquid, or any other items classified as hazardous or requiring specialist handling.

The Customer must declare in advance any items that may require special handling or disposal, including electrical equipment, refrigerators and freezers, mattresses, tyres, and construction debris, so that appropriate arrangements and pricing can be agreed.

The Company holds or operates under appropriate waste carrier registration and will endeavour to ensure that all waste is handled, transferred, and disposed of in accordance with prevailing laws and regulations. The Company may use third-party licensed waste transfer stations or recycling facilities, and the Customer authorises the Company to select such facilities at its discretion.

6. Pricing And Quotations

Prices are generally based on the volume and type of waste, weight where applicable, access difficulty, and any additional labour or waiting time. The Company may also apply surcharges for certain items or materials that incur higher disposal or recycling costs.

Any prices or quotations given before inspection are indicative only and subject to confirmation on site. If the final price differs from an estimated quotation due to changes in waste volume, type, labour required, or access conditions, the Company will inform the Customer before proceeding.

Unless otherwise stated, all prices are given in pounds sterling and are exclusive of any applicable taxes which will be added at the prevailing rate where required.

7. Payment Terms

Payment is due immediately upon completion of the Services unless otherwise agreed in writing. The Company may accept payment by cash, bank card, bank transfer, or other methods it makes available from time to time. The Customer agrees to ensure that adequate funds or credit are available for payment at the time of collection.

For commercial customers or account holders, specific payment terms may be agreed separately. In the absence of such agreement, payment is due on completion of the Services or within 7 days of invoice date, whichever is specified by the Company.

Where payment is not made when due, the Company reserves the right to charge interest on overdue amounts and to recover any reasonable costs incurred in pursuing the debt, including debt collection and legal fees.

8. Cancellations And Amendments

The Customer may cancel or amend a booking by providing at least 24 hours notice prior to the scheduled collection time. Cancellations or amendments must be communicated directly to the Company by the means specified at the time of booking.

If the Customer cancels with less than 24 hours notice, or fails to be present when required to grant access, the Company may charge a cancellation fee or a call-out charge to cover the costs of the failed collection, including travel and labour.

The Company reserves the right to cancel or reschedule a booking due to operational reasons, adverse weather, vehicle breakdown, staff illness, safety concerns, or other circumstances beyond its reasonable control. In such cases, the Company will make reasonable efforts to notify the Customer and arrange an alternative time. The Company shall not be liable for any loss or inconvenience arising from such cancellation or rescheduling, other than refunding any pre-paid amounts for Services not provided.

9. Service Performance And Timeframes

Any collection times given are estimates only and may be subject to change due to traffic, weather, operational issues, or other unforeseen factors. While the Company will make reasonable efforts to meet agreed timeframes, time is not of the essence unless expressly confirmed in writing.

The Customer must be available at the agreed time to grant access and confirm the waste to be removed. Where the Customer is not present, the Company may, at its discretion, proceed based on prior instructions or may treat the visit as a failed collection.

10. Customer Warranties And Responsibilities

The Customer warrants that they either own the waste or have full authority from the owner to request its removal and disposal. The Customer agrees to indemnify the Company against any claims by third parties alleging unauthorised removal of items from the property.

The Customer is responsible for ensuring that no valuable items, personal documents, or items intended to be retained are included in the waste. It is the Customer’s duty to check all items before collection. Once waste is removed and placed into the Company’s vehicle, it may not be possible to retrieve items, and the Company accepts no responsibility for any loss arising from such removal.

11. Liability And Limitations

The Company will exercise reasonable care and skill in performing the Services. However, the Company shall not be liable for any indirect, consequential, or purely economic losses, including loss of profits, revenue, or opportunity, arising in connection with the Services.

The Company’s total liability for any claim arising out of or in connection with the Services or these Terms and Conditions, whether in contract, tort, or otherwise, shall not exceed the total price paid or payable by the Customer for the specific job to which the claim relates, except where such limitation is not permitted by law.

Nothing in these Terms and Conditions shall limit or exclude the Company’s liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be limited or excluded under applicable law.

The Company shall not be held responsible for any damage to property where such damage arises from pre-existing structural defects, weak or insecure surfaces, or risks notified to the Customer. The Customer must inform the Company in advance of any fragile areas, underground pipes, or other relevant hazards.

12. Insurance

The Company maintains appropriate public liability insurance in connection with the performance of its Services. Details of such insurance may be made available to the Customer upon reasonable request.

13. Complaints And Disputes

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as reasonably possible, and in any event within 7 days of the collection date, providing full details of the issue.

The Company will investigate complaints in a fair and timely manner and may, at its discretion, offer to remedy any shortcomings where appropriate. This may include re-attending the property to collect remaining waste, issuing a partial refund, or offering a reduction on future services, subject to the circumstances.

14. Data Protection And Privacy

The Company will collect and process personal data from the Customer, such as contact details and service information, to manage bookings, perform the Services, and handle payments and communications. The Company will take reasonable steps to protect such data and will not sell the Customer’s personal details to third parties.

The Company may share necessary information with subcontractors, payment processors, insurers, or regulatory bodies where required to perform the Services, meet legal obligations, or protect its legitimate interests.

15. Force Majeure

The Company shall not be liable for any delay in performing, or failure to perform, any of its obligations under these Terms and Conditions where such delay or failure results from events, circumstances, or causes beyond its reasonable control, including but not limited to extreme weather, accidents, strikes, breakdowns, or acts of authorities.

16. Variation Of Terms

The Company reserves the right to update or amend these Terms and Conditions from time to time. Any changes will take effect from the date they are published or otherwise communicated and will apply to all Services booked thereafter. The version applicable to a particular Agreement will be the version in force at the time of booking.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by any court or competent authority, such provision shall be severed from the remaining provisions, which shall continue in full force and effect.

18. Governing Law And Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by the Company.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the Services and supersede all prior discussions, correspondence, or understandings relating to their subject matter.

By requesting a waste collection, confirming a booking, or allowing the Company’s operatives to commence work, the Customer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
